Terms and Conditions

• Information on prizes and how to enter form part of these Terms and Conditions. By entering in the 'Culture Kings x New Era x Major League Baseball' Promotion (Promotion), entrants agree to be bound by these Terms and Conditions.

How to enter

• The Promotion commences at 9:00 am AEST on 29 April 2026 and ends at 11:59 pm AEST on 19 May 2026 (Promotion Period). All times in these Terms and Conditions are in Australian Eastern Standard Time (AEST), regardless of whether daylight saving time is in effect in some states or territories.
• To enter this Promotion, entrants must, during the Promotion Period, purchase in-store at any Culture Kings retailer in Australia or online via the Culture Kings website (https://www.culturekings.com.au/) at least one (1) item from the following ranges  (each an Eligible Item):

• New York Yankees.

• Only the specific Eligible Items listed in clause 4 qualify for entry into this Promotion. For clarity, items from the following ranges are excluded and are not Eligible Items:
• New Era 9FORTY® A-Frame™ 10th Anniversary “Arcade Gold” range, featuring:
• Los Angeles Lakers; and
• Chicago Bulls.
• New Era 9FORTY® A-Frame™ 10th Anniversary “Rose Special” range, featuring:
• Los Angeles Lakers; and
• Chicago Bulls.
• New Era 9FORTY® A-Frame™ 10th Anniversary “Statement Suede” range, featuring:
• Los Angeles Lakers; and
• Chicago Bulls.
• For in-store purchases, entrants must provide their email address to staff at the point of sale at the time of purchase in order to receive an entry.
• Any orders placed or sales made via the New Era Cap Australia website or any other store will be not be eligible for entry.
• Each transaction containing at least one (1) Eligible Item will receive one (1) entry, regardless of the Eligible Items purchased within that transaction. There is no limit to the number of entries per entrant.

Eligibility

• The following eligibility criteria apply:
• The Promotion is open to residents of Australia only;
• Entrants under the age of 18 years must obtain and be able to provide evidence of consent from their parent or guardian to participate; and
• Employees, directors and their immediate families of the Promoter, Culture Kings retailers, New Era Cap Australia Pty Limited and organisers of Major League Baseball, and their respective related companies are ineligible. ‘Immediate family’ means spouse, partner, parent, step-parent, child, step-child, sibling or step-sibling, whether or not they live in the same household.
• The Promoter reserves the right to verify entry validity and entrant eligibility (including identity, age and residence) at any time and reserves the right to disqualify individuals deemed to have breached these Terms and Conditions, in its sole discretion.
• If requested by the Promoter, an entrant must provide evidence of eligibility to the Promoter.

Prize draw

• The prize draw will occur at 12:00 pm AEST on 20 May 2026 at 19-25 Russell Street, Melbourne, 3000, VIC.
• The first valid entry drawn will win the prize described below. Presence at the prize draw is not required to win.

Winner notification

• The winner will be notified in writing by email and/or by SMS using the contact details provided on the online order.
• The winner will be announced on the Culture Kings' Instagram account (@culturekings) on 20 May 2026
• If winner notification is returned to the Promoter undelivered for any reason such as the email address provided by the winner being invalid, then the Promoter will exercise reasonable attempts to contact the winner.
• If the winner cannot be contacted, does not claim their prize within 14 days of being notified, or is not available to travel on the dates set out in clause 21, the winner is taken to have forfeited the prize.

Prize details

• The winner will receive a prize consisting of:
• two (2) economy class return flights from the winner's nearest capital city to Philadelphia, Pennsylvania, United States, valued up to $8,400.00;
• five (5) nights' accommodation for two people in a twin share room valued at $2,200.00;
• Activ Visa digital gift cards, valued at $1,750.00;
• two (2) tickets to the T-Mobile Home Run Derby on 13 July 2026 and the 2026 MLB All-Star Game on 14 July 2026, valued at $1,980.00; and
• Culture Kings voucher valued at $1,000.00 redeemable at Culture Kings stores in Australia.
• Total prize value is up to $15,330.00, depending on point of departure. All figures are in Australian dollars (AUD) unless otherwise specified.

Prize conditions

• Prize is not transferable, exchangeable or redeemable for cash.
• If the winner is under the age of 18 years, the prize will be awarded to their parent or guardian. At least one of the winner or the winner's companion must be over 18 years of age.
• The prize must be taken to coincide with MLB All-Star Week. The winner and their companion must be available to travel between 10 July 2026 and 15 July 2026 inclusive.
• All components of the prize must be fulfilled at the same time. The winner and travelling companion must travel and take each component of the prize at the same time. The winner forfeits any part of a prize not taken within the available time periods stipulated in these Terms and Conditions or as otherwise notified by the Promoter, and no cash or alternative prize will be awarded in lieu.
• Tickets are non-transferable and no name changes are allowed. Any alterations to confirmed flights and/or accommodation details will be at the expense of the winner. Once the prizes have been arranged, any changes to the travel, flights, accommodation or scheduling arrangements are at the expense of the winner and their travelling companion. Any changes made by the winner to the specified prize package (including travel extensions, additional guests, etc.) will be subject to an administration fee of $250.00 excluding GST, which must be settled in full prior to booking confirmation.
• The Promoter reserves the right, in its discretion, to substitute a prize or part of a prize that is unavailable for an alternative of equal value and/or comparable specification.
• The Promoter is not liable for any part of the prize that is lost or stolen after being awarded.
• The winner and their travel companion are responsible for all costs associated with taking the prize, including but not limited to passport and visa/visa waiver costs, insurance, transport to and from the departure point, transfers, meals, beverages, additional spending money, taxes (including international and domestic transportation taxes, customs and inspection, safety/security, and passenger movement charges) and ancillary costs, other than those expressly stated as being part of the prize in these Terms and Conditions.
• Terms and conditions of the relevant prize suppliers and third-party service providers apply. The relevant airline’s conditions of carriage apply to all flights.

Travel and accommodation conditions

• Flights may be indirect. Airline, flight route and dates of travel are subject to the Promoter’s discretion provided the Promoter has acted reasonably and in compliance with all applicable laws.
• Travellers must be in possession of a valid passport before travel. Passports must be valid for at least 6 months after the expected return date.
• The winner and their companion must each obtain a visa or a visa waiver, as applicable, for travel to the United States. Citizens of eligible countries (including Australia) will need to apply for a visa waiver via the Electronic System for Travel Authorization (ESTA) prior to travelling to the United States. A fee will apply to new ESTA applications and renewals payable by credit or debit card at https://esta.cbp.dhs.gov. Any individual who is not a citizen of an eligible country will need to apply for a visa.
• The winner and their companion are responsible for obtaining their own travel insurance.
• The winner must present a valid credit card at hotel check-in for incidental expenses.
• The winner and travel companion travel at their own risk. If, for any reason, any aspect of this Promotion is not capable of running as planned, including war, terrorism, state of emergency, pandemic, or any other kind of disaster, tampering or computer virus, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

Activ Visa digital gift cards

• The gift cards are only redeemable at participating merchants.
• The gift cards are valid until the expiry date. Any unused portion of the gift cards after that date will not be available for use. Use of the gift cards is subject to the terms and conditions at https://activgiftcard.com.au/terms/.

2026 MLB All-Star Game and the T-Mobile Home Run Derby

• The 2026 MLB All-Star Game will be held on 14 July 2026 at Citizens Bank Park in Philadelphia, Pennsylvania, United States, and the T-Mobile Home Run Derby will be held at this location on 13 July 2026.
• The tickets do not include travel to and from the relevant venue, and other expenses unless otherwise specified.

Culture Kings voucher

• The Culture Kings voucher is redeemable at any Culture Kings retail store or online store in Australia.
• The voucher must be used by the expiry date. Any unused portion of the voucher will be forfeited. Use of the voucher is subject to the terms and conditions at https://www.culturekings.com.au/pages/terms-of-sale.

Unclaimed prize draw

• If the prize is unclaimed by the initial drawn winner, the Promoter will conduct an unclaimed prize draw at 12:00 pm AEST on 3 June 2026 at the same place as the original draw in order to award the prize.
• Any winner selected in the unclaimed prize draw will be announced on the Promoter's Instagram account on 3 June 2026.

General

• It is a condition of accepting any prize that the winner and their companion agree to:
• participate in all publicity (including photography) reasonably requested by the Promoter in connection with this Promotion and the result free of charge;
• consent to the use of their name, likeness, image and voice (including photo, film and recordings of same) in any media for an unlimited period without further remuneration for the purpose of promoting the Promoter's activities; and
• sign any reasonable legal documentation in relation to the matters in (a) and (b), including but not limited to a release and indemnity, in the form required by the Promoter and prize organisers in their absolute discretion and to the extent permitted by law.
• Save for any rights or guarantees under the Australian Consumer Law or other terms implied into a contract that cannot lawfully be excluded, the Promoter, Culture Kings Pty Ltd, New Era Cap Australia Pty Limited, Major League Baseball organisers and prize suppliers, as well as their respective related companies and their respective officers, employees, volunteers and agents, exclude:
• any representative or warranty as to the quality, suitability or merchantability of any prize;
• any term, condition or warranty that may otherwise be implied into these Terms and Conditions;
• any liability for direct, indirect, special or consequential loss (including but not limited to loss of profits, loss of revenue and loss of opportunity) arising in connection with this Promotion and the prizes, including but not limited to where arising out of:
• any technical difficulties or equipment malfunction;
• any entry or prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter;
• any variation in stated prize values;
• any tax liability incurred by a participant or the winner;
• any dispute between a participant and any third party relating to the participant's identity or entitlement to a prize; or
• any use or redemption of the prize.
• If the Promotion is interfered with or not capable of being conducted as anticipated for any reason beyond the Promoter's reasonable control, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, to the fullest extent permitted by law:
• to disqualify any person; or
• to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant regulatory authority.

Our Privacy Policy contains information about how individuals may request access to and corrections of information we hold about them, how to complain about how we handle personal information and how we deal with such complaints. We may disclose personal information to prize organisers and service providers, including New Era Cap Australia Pty Limited, organisers of Major League Baseball and others located in Australia and overseas, for the purpose of conducting this Promotion, publicising the outcome and co-ordinating the prize.
• Decisions of the Promoter in relation to this Promotion are final, provided the Promoter has acted reasonably and in compliance with all applicable laws. No correspondence will be entered into where this is the case.
